I understand that calling people back is a VERY important part of this model. I also understand that giving my callers call back options is very important to my overall volume, especially if I end before 7:00PM my local time.

DECLARATIONS: The signer of the digital document, herein referred to as “Purchaser”, understands that by furnishing payment and clicking the “Enroll” button at the bottom of this form Purchaser agrees to the following terms, conditions, and statements:

Purchaser understands that all weekly services are to be paid in advance for the week ahead or a previously scheduled week in the future.

CallCreator does not accept payments in bulk, or, for more than a week being purchased at a time.

Fountainhead Marketing Engineers and HackYourMarketing.com, while the full owners of CallCreatorPlus, make no claim or guarantee to CallCreatorPlus and exists with as a separate entity. No claim or guarantee made by any other company shall be applied to the product(s) offered by CallCreatorPlus. Purchaser understands any claim to guarantee, agreement, or any other issuance applied to product only appears on literature bearing the name clearly of CallCreatorPlus and is hereby notified that any other such policy is to hereby be disregarded immediately. GENERAL POLICY: Purchaser understands that purchaser is leasing telemarketing personnel only on a weekly basis. Purchaser understands CallCreator Plus makes no claim to success of any campaign, closing ratio, or viability of transferred calls. Purchaser also understands no claim or warranty is being made to volume of calls to be received, quality, or any other claim or warranty. Purchaser is simply purchasing labor to place as many calls as reasonably possible per agent per hour.

Purchaser understands the minimum agents purchaser can purchase is 5 and any additional agents are added in segments of 5.

Purchaser agrees that service is weekly and purchaser has full authority to stop, pause, or cancel any campaign by Thursday at 5:00pm the week prior to campaign running. Purchaser also has the right to stop, pause, or alter a campaign during its scheduled time however by doing so, Purchaser understands there is no claim to credit of any kind unless specifically authorized by management personnel in writing. REFUND POLICY: Purchaser understands once payment is issued and order is placed, the order cannot be changed or altered and purchaser is not entitled to a refund if requested alterations to schedule cannot be made.

Purchaser understands the following are not acceptable terms for a refund or credit: To few or too many calls, quality of call or interest level of prospects, poor closing ratio, any verbal representation of credit, refund, warranty, or promise, scheduling issues, or call frequency issues.

Acceptable reasons for credit or refund include: failure of CallCreatorPlus to fulfill any written promise or by complete abandonment of client account. Should there exist any record of CallCreatorPlus making one or more attempts to address and correct customer concerns governed by this agreement in a timely manner where such concerns were clearly made present to the staff members of CallCreatorPlus, Purchaser agrees to waive any right to refund or credit. PAYING BY CREDIT/DEBIT CARD: Should Puchaser purchase products from CallCreatorPlus, Puchaser understands that while Purchaser is entitled to reverse, chargeback, or dispute any credit card charges per the cardholder and the merchant account holder agreement, Purchaser agrees that Purchaser is to fill out a CallCreatorPlus refund request/dispute form PRIOR to initiating any dispute for review by CallCreatorPlus and to confirm receipt of signed form in wiritng from CallCreat. Purchaser agrees to allow 10 business days for proper processing and investigation of said refund request dispute form before contacting any bank or credit card company. LEGAL COMPLIANCE NOTICE: CallCreator Plus provides calling lists on behalf of Purchaser to calling center. Calling center vendor agrees that numbers are scrubbed against the National Do-Not-Call Registry once per month. Furthermore, all transfers are made to verbally verify they agree to call and will take no action against Purchaser, CallCreator Plus, or call center vendor in the event they are accidentally dialed and are on the DNC registry. CallCreator Plus hereby notifies that all telemarketing calling lists are available to Purchaser at any time for a secondary screening and compliance review Purchaser, purchasers agents, and purchasers insurance carriers agree to hold CallCreator Plus harmless in the event action should be taken for any telemarketing violations on the Federal, State, or Local level.

USEAGE OF LOGOS AND LIKENESS By enrolling with CallCreator Plus, you agree to hereby extend your rights and license to logos and likeness of your carrier(s) to be used by CallCreator Plus for the duration of your order for marketing purposes such as website and email flyers. Carriers include, but are not limited to, State Farm Insurance, Allstate Insurance, Farmers Insurance, and Nationwide Insurance. To opt-out from this provision, you may email your customer service rep any time or by entering an opt-out request in the comments box that appears above this electronic agreement.

AUTOMATIC REFERRAL OPT-IN By enrolling with CallCreator Plus, you agree to hereby allow CallCreator Plus to display your contact information on marketing materials and be listed as a reference for potential new customers. To opt-out from this provision, you may email your customer service rep any time or by entering an opt-out request in the comments box that appears above this electronic agreement.

Purchaser agrees that by providing payment information below purchaser authorizes CallCreator Plus to generate a signatureless bank draft for deposit. COURT COSTS/ARBITRATION: Should costs be incurred by either party to satisfy the terms of this Agreement, the prevailing party shall be entitled to reasonable reimbursement, including any expenses of litigation and reasonable attorney’s fees. Attorneys’ fee award shall not be computed in accordance with any court fee schedule, but shall be such as to fully reimburse all attorneys’ fees reasonably incurred in good faith. The invalidity of any provision of this Agreement as determined by a court of competent jurisdiction shall in no way affect the validity of any other provision hereof. This agreement shall be governed and be subject to the laws of the State of California.
